Terms of Service — Treasure Nepal

These Terms of Service ("Terms") govern your use of the Treasure Nepal website and the services we provide. By using this website or engaging us, you agree to these Terms. If you do not agree, please do not use the site or our services.

1. Who we are

Treasure Nepal is a sole-proprietor consulting and travel-design studio operating from 4704 Timber Oak Drive, Los Angeles, CA 90017, United States. The company is owned and operated by Kenneth Bodner.

2. Use of this website

You may use this website for lawful, personal purposes. You may not:

Reproduce, copy, or republish our content without written permission
Use automated tools to scrape, harvest, or collect information from the site
Attempt to gain unauthorised access to any portion of the site or our systems
Use the site in any way that could harm us or any third party

3. Our services

Treasure Nepal provides custom Himalayan journey design, cultural heritage consulting, and ethical artisan sourcing. Specific terms for each engagement are set out in the individual service agreement signed at the time of booking. Where these Terms conflict with a service agreement, the service agreement governs.

4. Booking, payment, and cancellation

Bookings

All bookings are confirmed only upon receipt of a signed service agreement and a non-refundable design fee or deposit, as specified in the agreement.

Payment

We accept payment in US dollars by wire transfer, ACH, or major credit card. Final payment is due 60 days before the start of any journey.

Cancellation

More than 90 days before departure: full refund of paid amounts, less the design fee
61 to 90 days before departure: 50% refund of paid amounts
60 days or less before departure: no refund

We strongly recommend trip insurance covering cancellation, medical evacuation, and lost baggage.

5. Travel risk and acknowledgement

Travel in the Himalayan region involves inherent risks including, without limitation, altitude, weather, remote-area medical access, and political conditions. By engaging Treasure Nepal you acknowledge these risks and agree that you participate at your own risk. We take every reasonable precaution and work only with vetted, experienced ground partners.

6. Intellectual property

All content on this website — text, images, design, code — is the property of Treasure Nepal or used with permission, and is protected by United States and international copyright law. You may not use any content commercially without written consent.

7. Limitation of liability

To the maximum extent permitted by law, Treasure Nepal's aggregate liability for any claim arising out of or related to our services is limited to the fees you have paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.

9. Changes

We may update these Terms from time to time. The current version is always posted on this page with a "Last updated" date.
